THE government Ombudsman report on the findings of the investigation into my asbestos exposure case against Two Rivers Housing (TRH) is extremely damning and critical of the firm and its actions.
The implication of this report against TRH are such that surely this firm cannot continue to operate with its board of senior managers still intact.
Serious failings have been found by the ombudsman regarding health and safety that cannot be ignored. TRH have the responsibility for thousands of tenants and the health and safety of those people are paramount.
The ombudsman report shows by my own exposure to dangerous substance and TRH failure to comply with HSE (Health and Safety Executive)?guidelines that tenants are at potential risk. TRH have shown in this report in my opinion that they are just not up to the job and I believe there must be a change at the top of TRH are to expect any public confidence by its tenants. Based on the contents of the government's ombudsman report and the catastrophic mistakes made by TRH and their contractors Rainbow International (RI) that have endangered the health of my wife and I, we consider the position of the chief executive, Mr Garry King, untenable and so ask for his immediate resignation.
The investigation carried out by the South Western Health and Safety Executive based in Bristol into my case of asbestos exposure during the summer of 2009 was totally shambolic, and my wife and I have always maintained that the investigation was inadequate, heavily flawed and lacked drive. For over a year my wife, myself and our MP Mark Harper have been constantly trying to get the HSE?at Bristol to open up a new investigation into my case. We have always maintained that crucial evidence and reliable witness testaments were totally ignored by the HSE?investigator and that the case was of such a
serious nature that prosecutions should have been brought against both firms involved rather than serve improvement notices.
Letters back in response to our request from the HSE have been negative and in the last letter I received from the head of the Bristol branch even suggested that the reason they did not prosecute was based on saving their resources which I take to mean money. The stance taken by the HSE is totally unacceptable and the whole concept of the HSE the reason for their creation was to ensure firms and individuals strictly complied with HSE?guidelines when handling or working with dangerous substances. The HSE guidelines are strict, sacrosanct and backed up by legislation. The ombudsman report vindicates our view that the HSE?investigation was inadequate and heavily flawed and therefore the HSE should have prosecuted both TRH and RI who acted illegally by not complying with HSE?guidelines. My wife, myself and our MP will now take our case to the highest level and not only am I requesting a full investigation into the failings of both firms already mentioned, but also an inquiry into the HSE at Bristol for its failure to uphold HSE directives.
